On Compensation for Pure Mental Damage

  • During a long-term accumulation of judicial theory and practice in common laws in Britain, America and France, the system of compensation for pure mental damage has undergone a long period from the beginning to its formation, from the increasing expansion of protection to the reasonable limitation of the over-extensive compensation responsibility. It has started the compensation for the pure mental damage of victims, perfected the protection system of civil rights, which has some progressive significance. Relatively, the legislation of such compensation started very late, and the relative theories and legislations fall behind. Such limitations will lead to the failure to protect fully the legal rights of civil subjects. Meanwhile, they are not helpful to the perfection of socialist legal system. Therefore, it is necessary to take some reference from the above mentioned countries and hence perfect our current system of compensation for pure mental damage.
