Reflections on Space-using Right of Land

With the economic development, the contradiction between the limitation of the land resource and the need for the social development has been increasing strikingly. And the spatial employment of land is becoming more and more universal. Consequently, the contradictions of such employment have increased. The space-using right of land is an independent usufructuary right and a new kind of property right. Property Law in China only provides principally space-using right of the land for construction purpose and it lacks maneuverability. Accordingly, we should perfect the types of space-using rights, the ways to obtain such rights and their extent and circulation.
