A Review of the Current Situation of the Prosecution of Environmental Public Interest Litigation in Hainan Province and Its Optimization

  • The Prosecution of environmental public interest litigation is significant for protecting the ecological environment, promoting sustainable development, implementing government responsibility, safeguarding public rights, and enhancing legal consciousness. Taking Hainan Province as an example, the establishment of a distinctive and comprehensive prosecution of environmental public interest litigation system is a prerequisite for practicing the theory of “Two Mountains”, and is also an important issue that cannot be ignored in the process of the “green development” of Hainan Free Trade Port. However, through an examination of the judicial status quo of the prosecution of environmental public interest litigation in Hainan Province, it is found that there are current issues such as deviations in the functional positioning of procuratorial organs, oversights in the procedural systems of pre-litigation procedural systems, and challenges in the harmonization of litigation procedural rules. It is recommended to address these issues by clarifying the primary role of procuratorial organs in supervision, emphasizing the independent value of pre-litigation procedures in public interest litigation, and improving the harmonization of the system of procedural rules of litigation.
