An Empirical Study of Scope and Procedure ofExclusionary Ruleof Illegally Obtained Evidence

With the selected 216 judgment documents as the basis, this paper has analyzed the scope and procedure of illegal evidence exclusion from some judicial practice like application reasons and scope for exclusionary rule of illegally obtained evidence, public execution organs' proof offering, courts' disposition, and relation with verdicts. And it especially has put forward some instructive suggestions to some typical judicial issues as repeated confession, confession obtained during the period when the party is deprived of freedom illegally caused by the illegal procedure of investigation, and the independent review procedure of the illegal evidence.
