On Formation of the Principle of No Harm to Foreign Environment: A Perspective of Trail Smelter and Corfu Channel Cases

  • “No harm to foreign environment” is an extremely important principle of the international laws concerning environment. It appeared first in the two famous cases of Trail Smelter and Corfu Channel. The roles of the two cases in the formation of such principle lie in the following. First, they are the material elements in this international convention. Second, they introduced the ban of power abuse into the international laws concerning environment and lay the solid foundation for the legal confirmation.
